Referral Package - State of California
The referral package contains the following documents and information:
- Executed Substitution of Trustee or Power of Attorney
- Executed Declaration for filing with the NOD
- (pursuant to CA law changes 9/8/08)
- Copy of the Deed of Trust
- Copy of the Note with endorsements
- Copies of all recorded Assignments
- Copy of Title Policy
- Any additional mailing addresses for the mortgagors/owners
- Loan Status Screens and Default Information
- Name of beneficiary/bank in which foreclosure should be conducted
The referral also includes the following information, when available, to ensure a valid foreclosure:
- Executed Military Affidavit (blank forms can be forwarded in advance).
- Occupancy status (vacant or occupied), if occupied, the names of the
- occupants.
- Current or prior bankruptcy information.
- Copies of documentation regarding all liens, claims or other encumbrances due to damages related to the property or pending insurance claims.
- Social security numbers of current owners.
It is critical that the Declaration and Substitution of Trustee be received with the referral package to initiate the foreclosure in a timely manner.
