Eviction - State of Nevada
Evictions follow the general procedures of non-judicial foreclosure states with the attendant delays and problems caused by the fact that it is a separate judicial case. Eviction is initiated once the Trustee’s Deed Upon Sale has recorded. Once recorded, the three- and five-day notices to vacate are sent to the former mortgagors, tenants, occupants and property management companies. A Complaint in Unlawful Detainer and Motion for Writ of Restitution are filed after the expiration of these periods.

A hearing is set within 30 days of the filing of the compliant and motion, and, if uncontested, an order granting possession and a writ of restitution are granted. The time for possession may be specified in the order. The constable serves notice on the occupants to vacate within 24 hours and physically removes them after that time if they do not vacate. Possession is then given to the owner per the court order. The lender must provide movers and securing personnel at the time of eviction.

Any personal possessions remaining on the property of value are placed in storage and, unless claimed, are auctioned at a later date.
