Deficiency Judgment - State of Washington
If the lender elects to pursue a deficiency judgment, the deed of trust must be foreclosed judicially as described below. Recent case law prohibits the VA from pursuing a deficiency based on its guaranty unless the deed of trust was foreclosed judicially. At the time of this publication, the Veterans Administration makes a determination whether to foreclose judicially or non-judicially on a case-by-case basis.
