Eviction - State of Washington
The successful bidder at a trustee’s sale is entitled to possession on the twentieth day following sale. A 20-day letter demanding that the subject property be vacated is sent certified and regular mail to the borrower and any occupants. If the premises are not vacated voluntarily, the purchaser has the right to summary eviction proceedings. A Summons and Complaint to evict are filed.

An Order to Show Cause is obtained from the court compelling the occupant’s appearance at a hearing to determine why a Writ of Restitution should not be entered. The Order to Show Cause must be served on the occupants at least six days prior to the hearing but not more than 12 days prior. Judgment will be entered in favor of the purchaser if no one appears or if just cause to deny issuance of the Writ is not proved to the Court. The Writ of Restitution is then delivered to the sheriff for service on the occupants. If the occupants do not vacate within 72 hours, at 9:00 a.m. the following morning, the sheriff will eject the occupants. The sheriff supplies the movers. In some counties, a bond indemnifying the sheriff must be posted prior to eviction.
